CMS Advises Biggest Romanian Photovoltaic Park on Grid Access

Romania’s largest photovoltaic park to date (45 MW) is being connected to the grid. The international law firm CMS Reich-Rohrwig Hainz advises the developers Green Source and LSG GROUP (the latter also acts as building contractor and project developer) as well as the park operator Alpha. The total investment volume amounts to EUR 100 million.

Even though the photovoltaic industry is in economic turmoil around the globe, it has experienced a small boom in Romania since the end of 2011. In Giurgiu, located south of the capital Bucharest, the 45-megawatt photovoltaic park is being connected to the grid.

CMS provided legal advice on Romania’s largest photovoltaic project to date. CMS already supported the developer Green Source and the building contractor and project developer LSG GROUP in 2012, when a Korean conglomerate acquired the majority of shares of the photovoltaic park. This time, CMS advised their clients as well as the park operator LJG Green Source Energy Alpha s.r.l. on all legal questions concerning the development and grid access of the solar park. “We are very happy to have achieved grid access in this remarkable project together with our clients despite the unstable regulatory environment”, says energy law expert Johannes Trenkwalder, partner at CMS in Vienna.

A team of Austrian and Romanian CMS experts was responsible for the mandate. In Vienna, CMS partner Johannes Trenkwalder, Clemens Grossmayer (senior attorney) and Dieter Zandler (senior attorney) supported the clients in all matters of civil and corporate law. CMS partner Thomas Hamerl advised on the EPC contract (engineering, procurement, construction) and CMS partner Günther Hanslik was the leading expert in all questions of financing. Horea Popescu (partner, corporate law) and Loredana Mihailescu (senior attorney, regulatory law) provided on-site advice.
