On 13 Novem­ber 2018, the Court of Justice of the EU (“CJEU”) rendered a sig­ni­fic­ant new judg­ment re­gard­ing the ques­tion of wheth­er the taste of a food product is a “work” that is eli­gible for copy­right pro­tec­tion.
