Canada ratifies the Madrid Protocol, Brazil could follow in its footsteps

On June 17, 2019, the Madrid Protocol will enter into force in Canada, which becomes the 104th member state of the Madrid System, which now covers 120 countries.

From this date, it will be possible to designate Canada as a designated territory in an international trademark. This change coincides with the introduction of new legislation in Canada that brings a series of significant changes in the applications for trademark registrations, in particular the adoption of the Nice international classification and the deletion of the use requirements.

The new Canadian legislation is a long-awaited change that should translate into a more efficient and economic registration process, either through the Madrid System or through the filing of national applications.

The next country to join the Madrid System could well be Brazil, since on April 4, 2019 the Chamber of Deputies approved the union, passing the bill to the Senate for its respective approval.
