CMS advises STRABAG on successful agreement with ISS on transfer of more than 3,000 workers

Cologne – STRABAG Property and Facility Services GmbH (STRABAG PFS) has signed an agreement with ISS Facility Services Holding GmbH (ISS) regarding the continued employment of more than 3,000 workers. The agreement relates to the change in facility management service provider for Deutsche Telekom AG and its subsidiaries in Germany. As of 1 July 2019, facility management services will be provided by ISS. The STRABAG PFS and STRABAG Facility Services GmbH (STRABAG FS) employees affected by the change of service provider will receive an offer of continued employment from ISS with effect from 1 July 2019. The agreement is currently awaiting the customary approval from the authorities.

A CMS team led by Prof. Björn Gaul advised STRABAG Property and Facility Services on all employment law implications of the change in service provider and on tax and company law issues. The team also represented the company in its negotiations with Deutsche Telekom AG and ISS Facility Services Holding GmbH on the transfer of more than 3,000 employees. CMS has previously acted for STRABAG’s construction division; this new instruction involves the Facility Services division for the first time.

STRABAG Property and Facility Services GmbH is a leading real estate and industrial service provider in Germany. Its service portfolio covers technical and commercial management of entire sites and complete portfolios of industrial companies and real estate firms.

ISS is a facility services provider headquartered in Copenhagen. The company’s service portfolio includes building services, cleaning, catering, security, capital projects and integrated facility services.
