Welcome to the fourth edition of Disputes Digest, featuring commentary and analysis on the latest developments in dispute resolution across the UK and beyond.

Over the summer, the debate over the legal issues arising from BREXIT has sharpened. With autumn upon us, the mood appears to be ‘business as usual’, while the political debate goes on. We have, therefore, resisted the temptation to publish a ‘BREXIT Special Disputes Digest’.

Instead, this edition includes updates and commentary on current contentious issues, including disputes in elite level sport, progress in the High Court’s ‘Financial List’, and recent cases on aggregation of claims and exclusion of liability in commercial contracts. We also consider Lord Thomas’ BAILLI lecture in which he spoke about the impact of arbitration on the development of the common law, and take a look at the future of Intra-EU bilateral investment treaties and the Transatlantic Trade and Investment Partnership.
