Comment to the public procurement standard forms for procurement notices

March 2019

CMS took part in the public consultation process regarding the new standard e-forms for procurement notices. CMS strongly supports the European Commission’s aim of reducing the number of existing forms and simplifying those that remain. Another big step forward is the idea of explaining the meaning of each field in these forms, since properly understanding them is crucial. Based on our long-standing experience, CMS combined its forces and public procurement lawyers from our offices in Amsterdam, Budapest, Cologne, Prague and Vienna suggested further improvements. Hopefully our feedback will contribute to making e-forms easier for contracting authorities in the future and at the same time increase transparency and cross-border trade. Special thanks to Christian Scherer-Leydecker (CMS Cologne), Maartje Speksnijder (CMS Amsterdam), Veronika Kovacs (CMS Budapest), Lenka Krutakova (CMS Prague), Bernt Elsner (CMS Vienna) and their teams.
