Editorial

Dear Reader,
You would expect your lawyer to keep abreast of the law. We believe that this is not enough. Not only should our lawyers know the law, but they should use it to find the most efficient solutions to the problems you are facing, or even better, prevent them. In order to achieve this they also need to develop their non-legal skill set.
In this context CMS DeBacker was privileged with hosting CMS’ third Dispute Resolution Academy two weeks ago. This drew 48 CMS litigation lawyers from over 20 countries for a two-day training in Brussels. This year the theme was “Negotiation in a conflicting pretrial situation”. Participants were put in a realistic, time-critical, international environment, and were asked to negotiate practical solutions, with the support of two international trainers (an experienced US trial judge and an Australian solicitor).
Wining a court trial is nice but it is costly and time consuming. Whenever possible, we suggest using alternative dispute resolution tools, negotiation being one of them.

André Lombart - Head of the Commercial & Dispute Resolution Practices
