AMENDMENT TO THE LAW ON WEEKLY REST MAKING IT EASIER FOR RETAIL OUTLETS TO OPEN ON SUNDAYS

Act No 1,471 of 2 July 2019, amending Act No 822 of 23 June 1967 on weekly rest was published in Monaco’s Official Journal on 5 July 2019.

While the principle of Sunday as a rest day remains, a new exemption system has been introduced to the benefit of retail outlets.

The law maker's decision is part of the extension of the “Monaco Sunday Experience” campaign, which aims to respond to the real needs of the economic operators in the Principality and increase the attractiveness of their shops.

Accordingly, managers of retail outlets can now be exempt from the principle of Sunday as a rest day, by offering all employees a day other than Sunday as a rest day for up to 30 Sundays per employee per year, or on a rotating basis, to all or some employees.

Voluntary participation lies at the heart of the new system, which aims to simplify procedures and ensure greater contractual freedom between employers and their staff.

A refund system for employers’ social security contributions is also provided for, to offset the cost of introducing a compensation scheme for employees who work on Sundays.
