The importance of procurement law continues to grow. Legislation is subject to continuous change. In addition, parties are confronted with a constant stream of national and European case law which plays its part in determining the contours of procurement law. We offer this course as a legal introduction to procurement law for professionals who have to deal with procurement law in practice. We will outline the theoretical framework, while at the same time providing points of reference for a practical application of this area of law. The main aspects of procurement law will be studied in depth, based on the literature sent to participants beforehand, case law and a homework assignment.

Introduction to procurement law
— legislation and regulations
— general principles of procurement law
— contracting authorities
— contracts subject to a compulsory call for tenders
— types of tender procedures
— exceptions to the obligation to issue a call for tenders
— the tendering phase

Programme Tuesday 22 June 2010, 3 pm - 6 pm
Selection & Award
— grounds for exclusion/integrity and conflict of interests
— suitability requirements and selection criteria:
- economic and financial capacity
- technical and professional competence
- consortium / subcontracting
— award criteria:
- establishing the requirements / criteria
- assessment methods
- errors and deficiencies in invitations to tenders and the tenders themselves
- strategic tendering
- award decision

Programme Tuesday 28 September 2010, 3 pm - 6 pm
Following the provisional or definitive award decision
— legal protection:
- Remedies Directive and the new Act implementing this directive (WIRA)
- remedies
— amendments to the agreement

NovA points
The NOvA awards six permanent training points to this extension course on procurement law.

Participation costs
The cost of this 3-day course is € 950 (excluding VAT) per person. You will receive a reader with literature, legislation and relevant case law on the subjects that will be dealt with during the course. Once we have received your registration we will send you confirmation and the invoice.

CMS Derks Star Busmann reserves the right to cancel the course at any time if there are not enough participants. You will be informed in good time if this is the case.
