New Developments in Procurement Law in Municipal Area Development (in Dutch)

On Wednesday 7 October 2009 CMS Derks Star Busmann, in cooperation with Living Vision, is holding a seminar on New Developments in Procurement Law in Municipal Area Development.

This is a small-scale interactive seminar in which current practice in the area of procurement law as it relates to municipal area development is reviewed both for and by various municipalities in the Province of North Holland. Legal aspects, procedural and practical tips and the possibilities of how to take advantage of opportunities will be examined.

Mr S. H. Binnendijk, the Alderman responsible for the Environment and Spatial Planning, will give the introduction. Alkmaar recently completed a complex tendering process for the 'Overstad' project. This involved using a 'competitive dialogue'. In this form of tendering the public authority makes optimal use of the creativity of the participants in the market.
This will allow the Municipality of Alkmaar to build a large-scale area development in close cooperation with market parties. Mr Binnendijk will comment on the positive experiences he gained in the course of this project and its tendering process.

During the seminar Petra Heemskerk (CMS Derks Star Busmann) will examine in greater detail various current aspects of procurement law relevant to municipal area development. Attention will be paid to case law, including European case law, practical aspects and to the recent report by the Dutch Interdepartmental Committee on European Law (ICER after its Dutch initials) with particular focus on competitive dialogue.

Living Vision will give an introduction on the question of how an area development and its associated selection procedure can in practice be organized and how municipalities can take best advantage of opportunities as regards the effectiveness of the process, the set-up of the internal organization and communication.

The seminar on New Developments in Procurement Law in Municipal Area Development will be held in Alkmaar’s town hall on Wednesday 7 October 2009 from 3:00 pm to 6:00 pm.
