CMS Guide helps companies navigate their way through key dismissal legislation

In the current economic climate, many companies are being forced to look closely at their staffing levels and to make difficult choices. This task is made harder by the complexity of legislation relating to dismissal of staff. In many jurisdictions, different conditions apply to the dismissal of employees and managing directors. There are many other significant differences in the relevant employment laws between EU jurisdictions, which in turn differ fundamentally from legislation outside the EU.

The first part of the CMS Guide to Dismissals deals with termination procedures for employees and the second part for managing directors. Both provide a summary of local laws across 24 countries, making it easier to understand both the similarities and differences between each jurisdiction. The jurisdictions include: Austria, Belgium, Bosnia and Herzegovina, Bulgaria, China, Croatia, Czech Republic, France, Germany, Hungary, Italy, Luxembourg, The Netherlands, Poland, Portugal, Romania, Russia, Serbia, Slovakia, Slovenia, Spain, Switzerland, Ukraine and the United Kingdom.

Co-head of the CMS Employment and Pensions Practice Group Fernando Bazán of CMS Madrid comments: "Past experience has shown us how complex this area can be for our clients, in particular when they are operating in several jurisdictions. So we designed the Guide to help them assess the implications of dismissals in a local and international context".
