Monika Ploier Is a New Partner at CMS

International law firm CMS Reich-Rohrwig Hainz again welcomes a new partner: as of 1 February 2014, Monika Ploier (32) is a partner at CMS

“In the past years, Monika Ploier has developed extensive and well-founded expertise in medical law. With her energetic personality and intuition about the clients’ needs, she has significantly contributed to establishing our law firm in this practice area. Dr. Monika Ploier has been a member of international law firm CMS Reich-Rohrwig Hainz since 2005. The senior attorney completed a doctorate at the law faculty of the University of Graz in 2005. She continued to focus on medical law, which she had chosen as a field of speciality already during her studies, also at CMS and has continuously extended and developed this practice area ever since joining the firm. She especially works with health-care institutions and advises on aspects of hospital law, civil and criminal law aspects of medical malpractice law as well as the foundation of medical practices and anti-corruption law. On top of her specialisation in medical law, Monika Ploier is a member of Austria’s largest labour law team and advises on labour law aspects in cases involving health-care institutions.

She is a sought-after speaker at medical conferences, a published author in this field and also frequently writes papers for medical journals. These include “Die Patientenverfügung” (living will) with Petutschnigg in 2007; “Behandlungsfehler in der Medizin” (medical malpractice) with Prutsch in 2005; “Organisationsverschulden in Krankenanstalten anhand von konkreten Fällen aus zivilrechtlicher Sicht” (organisational liability of hospitals from a civil law perspective based on example cases) in Hilf/Pateter/Schick/Soyer [eds.], Unternehmensverteidigung und Prävention im Strafrecht (defending companies and prevention in criminal law), 2007.

In 2008, she founded the non-profit organisation FIRM – Forschungsinstitut für Recht in der Medizin (research institute for legal aspects of medicine) together with other legal and medical experts. FIRM fosters the dialogue between medical and legal experts, which Monika Ploier has come to regard as highly important in her many years of experience in this field.
