English Law Desk | CMS Austria pools expertise in English law in dedicated...
Published on 03 July 2023We are pleased to announce the launch of our English Law Desk. Our English Law Team focuses on English law governing finance and corporate/M&A transactions as well as dispute resolution. The team consists of highly qualified lawyers, among them CMS partners Marcell Clark, Alexander Rakosi and David Kohl as well as solicitor Anna Freund. Marcell Clark (Banking & Finance), Alexander Rakosi and David Kohl (both Corporate/M&A) and their teams have extensive expertise in advising on banking and finance as well as corporate/M&A transactions governed by English law, regularly working on some of the most important deals in the region. Anna Freund is an expert qualified in English law with extensive experience in handling litigation and arbitration in various industries. She recently joined CMS's dispute resolution team and contributes valuable expertise in English law governing dispute resolution practice. The English law department of CMS Austria works with a wide range of internationally active clients, including banks, institutional and financial investors, corporations, industrial conglomerates, DFIs, debt funds, national and international development organisations, government institutions and public authorities. We believe that the launch of our English Law Desk enables us to provide comprehensive and high-quality legal services to our clients. CMS Life Science Award 2022

Launch of research cooperation between University of Innsbruck and CMS...
The Faculty of Law at the Leopold Franzens University of Innsbruck and CMS Austria are partnering to promote university researchers in medical law. CMS will support the research centre for medical law at the University of Innsbruck both financially and in relation to content. The CMS Life Sciences Award is also being introduced. A cooperation agreement was recently signed by Univ.-Prof. Dr. Walter Obwexer, Dean of the Faculty of Law, and Dr. Gabriela Staber, Partner, and expert in the field of Life Sciences & Healthcare at CMS Austria. The cooperation aims to further advance research in the field of medical law. The research should provide answers to many un­der-in­vest­ig­ated or new legal questions in this area. CMS provides input from the practice  The cooperation will further intensify the teaching and research focus in medical law that has been successfully established at the University of Innsbruck Faculty of Law. Through CMS, one of the leading national and international law firms in the field of Life Sciences & Healthcare, students will receive valuable input from the practice in the future. They will be able to resort to a pool of current topic suggestions for dissertations, master's theses, and seminar papers with particular focus on pharmaceutical and medical device law as well as biotechnology. Award for exceptional achievements  Another important part of the research cooperation is the CMS Life Sciences Award, which will be presented once a year. The award is endowed with EUR 2,500 and is intended for students whose excellent dissertations, master's theses or seminar papers make an important contribution to research in medical law. In addition to the CMS Life Sciences Award, conferences and networking events will be facilitated. These will focus on information and the exchange of new results to help students and academics better understand topics relevant to the field. No development without research Univ. Prof. Dr. Walter Obwexer says about the research cooperation: "Our students, directors and staff at the research centre are united in their endeavour to ensure the permanent development of medical law through their commitment and results. We are very pleased to be working with CMS, as the cooperation will enable us to offer an even better organisational, financial and personnel framework for relevant research projects."CMS partner Dr. Gabriela Staber, who herself advises pharmaceutical, medical and biotech companies, hospitals as well as healthcare start-ups, emphasises: "Of course, there will be many pressing questions and challenges over the coming years, especially in health law. This makes it all the more important to support research activities and thus also create an academic basis for practical work. We see ourselves here not only as a supplier of ideas and topics but also as an interface and contact broker between university research and companies in the life sciences & healthcare sector." Medical Law and Public Health at the University of Innsbruck For 20 years now, the Leopold Franzens University of Innsbruck has been focusing on medical and health law. With the University Course in Medical Law, the Summer School Medical Law, the Doctoral College in Medical Law and Health Care and the Research Centre for Medical Law, there are now four pillars that support teaching and research in equal measure. Not least, for this reason, the University of Innsbruck sees itself as an authoritative hub for medical law issues.

CMS participates in the Balkan Green Energy News Conference on the Changing...
The conference "Serbian Companies on the Changing Power Market" organised by Balkan Green Energy News gathered together numerous players in the renewable energy market. An industry meeting of regional importance On 22 February 2022, leading electricity market experts from Serbia and abroad met in Belgrade to discuss key issues in the Serbian energy sector. The topics were relevant for the entire region. The experts provided insights into both the way the Serbian electricity market would likely develop in the coming years and the opportunities available to various market participants. The conference offered an analysis of the most important challenges facing companies in the course of the energy transition. CMS also relies on innovative advisory products to help its clients benefit from the energy transition. The conference was opened by Serbian Deputy Prime Minister Zorana Mihajlović and Director of the Energy Community Secretariat Artur Lorkowski. CMS was a sponsor and participant of this crucial event for the energy sector and was delighted to be represented onsite by its lawyers Ivan Gazdić, partner CMS Serbia, Georg Gutfleisch, lawyer CMS Austria, and Tamara Kosi, lawyer CMS Slovenia, and Maja Živanović, Business Development Country Head, CMS Serbia, Montenegro and North Macedonia.  One step ahead in the energy crisis The 2021 energy crisis has continued into 2022 causing unprecedented increases in electricity prices across Europe. The Serbian government has put up a rescue parachute for companies and capped the electricity price at EUR 75 per MWh for the period until June 2022. However, it remains to be seen how electricity prices will develop in the medium and long term. In the coming years, the Serbian electricity market will – like the entire region – be affected by other important changes too: decarbonisation and the need to align its business with the Green Agenda; the projected growth in solar and wind capacity; the increasing attractiveness of customers producing their own energy onsite; and the carbon cap tax on exports to the EU. The conclusion was: “The event ‘Serbian Companies on the Changing Power Market’ provided an excellent opportunity for the exchange of information and ideas that are urgently needed to better understand trends in the power market and to remain competitive". CMS heads into the future stronger with new leadership
Johannes Juranek and Günther Hanslik will take over management responsibilities at the Vienna law firm CMS on 1 February 2022. Together they want to make the firm fit to face the challenges of the future. CMS Reich-Rohrwig Hainz Rechtsanwälte GmbH will have a leadership duo as of 1 February 2022 comprising data protection specialist Johannes Juranek, who has already led the firm successfully for the past three years, and banking partner Günther Hanslik. They have been elected by the firm’s partners as managing partners for the next three years. CMS Austria already has a leading position in Central and Southeast Europe and has offices in Vienna, Belgrade, Bratislava, Istanbul, Kyiv, Ljubljana, Podgorica, Sarajevo, Skopje, Sofia and Zagreb. Together, the new management duo wants to further strengthen the positioning of the law firm, one of the most renowned in Austria. To this end, they will expand the firm’s core competencies, make CMS an even more attractive employer for the best lawyers in the country, advance digitalisation, and continue to oversee the successful implementation of the “Vision 2025” strategy. Jo­hannes Juranek will be responsible for IT and the development of new innovative technical tools over the next three years and continue to represent the company in the CMS global Executive Committee. Günther Hanslik will be responsible for Human Resources, Marketing & Communications, Business Development in both Austria, and the company's locations in the CEE countries. The financial area is jointly supervised by the two. CMS is one of the most technically innovative law firms in the country. For example, Lupl. com, an international platform for the exchange of information between legal departments and law firms, was developed together with external partners and very successfully launched on the market. Johannes Juranek: “New technologies and digital offers are of great importance to our clients and appreciated by companies and public authorities alike. In recent years, we have repeatedly proven that we are among the market leaders in the digitalisation area. We want to further strengthen this position and expand it in all areas.” Gün­ther Hanslik: "We are constantly improving the quality of our services. The new management will also focus on the topics of sustainability, increased CEE integration and diversity. Günther Hanslik: “At CMS, we are mindful of resources in all departments. We are also the first law firm to have an eco-profit cer­ti­fic­ate.” The bar is also set high for the new management team in terms of economic success: CMS Austria achieved the highest turnover in its history in 2021. “This is a great challenge for us, which we gladly accept, and which motivates us to become even better to meet the high demands,” says Johannes Juranek.

Hydrogen in Austria: Waiting for a strategy
All over the world, hydrogen is increasingly seen as one of the key drivers of the energy transition. An increasing number of countries are formulating strategies and announcing investment programs to foster the development of hydrogen projects, especially green ones. In Austria, initial plans of a strategy for the use of hydrogen were announced more than three years ago but little has happened since then – at least politically.
