Duties to inform before concluding a contract

07/07/2015

A duty to inform not only appears in individual cases. The author carried out an extensive analysis of the judicature and thereby demonstrated that significant structures exist related to precontractual duties to inform. As well as the question of what information the parties may reasonably expect to receive when concluding the contract, the focus of the article further lies on how their behaviour can change these reasonable expectations. The author goes on to develop a closed system of pre-contractual duties regarding providing information for the respective parts of the contract. Special attention is paid to company purchases in all their various facets.
