2010 has been a challenging year for many consumer products (CP) companies across the globe. Sustainability and social responsibility, brand protection, corporate restructuring, supply chain imperatives and an ever stricter regulatory environment are among the top issues facing consumer products companies in 2010. If you factor in threatening unemployment and a slowdown in consumer spending in mature markets like the U.S., the UK, Germany and Japan, CP companies may find themselves playing a zero-sum game: is the only way to grow significantly through strategic acquisitions or by stealing market share? In this challenging economic context, Competition authorities across the EU have been very active, investigating and imposing very high fines even for practices which, according to some commentators, have been widely applied to protect brands and investments.

Mr James Higgins, Senior Regional Counsel Great Britain & Northern Europe; Diageo
