On March 2, 2023, China Network Baden-Württemberg (CNBW) and CMS, China jointly held a webinar on What is new in Chinese law – Topics which may concern you in 2023.
Mr. Jochen Schultz, Managing Director and Member of the Board at CNBW was the moderator of the webinar and gave opening remarks. Dr. Ulrike Glueck, Managing Partner and Head of Corporate Practice Area Group and TMC Sector Group of CMS, China introduced the new corporate structure for joint ventures and potential amendments to the PRC Company Law. Ms. Jeanette Yu, Partner and Head of Employment & Pensions Practice Area Group of CMS, China provided an overview on updates of PRC Employment Law. She introduced the new legal requirements for women protection in the workplace, the development of Chinese social insurance mechanism and shared her insight on how to manage labor costs in times of difficulties. Ms. Panpan Tang, Senior Associate of CMS, China shared potential updates to the PRC Trademark Law and the legislative developments in cross-border data transfer. She further introduced the requirements for compliant cross-border data transfer.
Participants from multinational companies in different industries joined the webinar and had the opportunity to raise questions in the Q&A section.
In China, amendments of existing legislation and new laws will come in various areas. Besides what has been mentioned during the webinar, the PRC Insolvency Law is also planned to be amended, China's Competition Law regime will be further strengthened, and the Corporate Social Credit System will be further streamlined etc. Companies need to keep close eyes on the legal updates and take timely measures to adapt to the new requirements and to use the developing legal framework to best shape the day-to-day businesses.
