CMS, China talks about internal investigations in HR cases

CMS Employment Group has been organizing a webinar series on the topic "Internal investigations in HR cases – best practices" in 24 CMS jurisdictions. CMS experts will introduce how to run internal investigations in each jurisdiction and provide answers to the following questions What are the do’s and don’ts? What are the best practices? and What recent developments are there?

The webinar for China was held on March 31, 2020. Jeanette Yu, Partner and Head of Employment & Pensions Practice Area Group of CMS, China together with Sophy Wang, Associate of CMS, China gave speeches and shared their insights on this topic. Jeanette and Sophy introduced the causes of internal investigations, the ways to conduct investigations and the issues that employers shall pay attention when conducting investigations. They also talked about the role of trade unions in China. Participants raised many questions they faced in practice, e.g. whether the company can check the employee's computer and WeChat for internal investigations, whether the employer and the employee can make recordings during interviews, etc. Jeanette and Sophy answered the questions one by one.
