CMS advises Swiss utility ewz on acquisition of two Nordex wind farm projects in France

21/12/2017

Hamburg – The Swiss utility ewz, the public utility company of the City of Zurich, is further expanding its renewable energy portfolio by acquiring the two onshore wind farm projects "Autremencourt" and "Vihiersois" from Hamburg-based Nordex SE.

A binational CMS team of German and French lawyers headed by lead partner Dr Holger Kraft and lead counsel Matthias Sethmann has provided ewz with comprehensive legal advice in relation to this cross-border transaction. This included due diligence of both projects as well as the negotiation of the contracts for the acquisition, the project development, the turnkey realization and the long-term maintenance of the projects. The projects are intended to be completed by 2018 and 2019, respectively, and will together comprise 15 wind turbine generators from the Nordex N117/2400 series. The installed capacity of both projects will be 36 megawatts in total and the annual energy production about 100 gigawatt hours.

ewz is a leading utility company in Switzerland. ewz accepts responsibility for a sustainable energy future and offers its customers innovative products and business ideas. The public enterprise is investing heavily in the expansion and promotion of renewable energy sources and is eager to substantially increase its production of electricity from wind power and solar power over the coming years. The acquisition of the two wind farms Autremencourt and Vihiersois is to be considered as an important milestone in this context. With this acquisition, ewz boosts its overall energy production from wind power by 22 percent to 550 gigawatt hours per year.

Nordex SE is a listed company with its headquarters in Hamburg and an annual turnover of 3.4 billion euros. Nordex SE, with its approximately 5,000 employees, is one of the world's leading manufacturers of wind turbine generators and has so far installed more than 21 gigawatts of capacity in more than 25 countries.
