CMS again advises EnBW AG on signing long-term power purchase agreement with Energiekontor AG

Hamburg – Energy group EnBW Energie Baden-Württemberg AG has signed a 15-year power purchase agreement (PPA) with wind energy project developer Energiekontor AG. The solar park in the municipality of Dettmannsdorf (Mecklenburg-Western Pomerania) will generate green electricity and have a total output of around 52.3 MW. As on the previous occasion, this solar project does not make use of the statutory production subsidies available under the Renewable Energy Act (Erneuerbare Energien-Gesetz – EEG). Commissioning is scheduled for the second quarter of 2022.

A CMS team comprising lead partner Dr Holger Kraft and Dr Constantin Lentz advised EnBW on all legal aspects of negotiating the PPA, working together with inhouse senior counsel Hans-Jürgen Hertel. CMS previously advised EnBW on signing a PPA with Energiekontor for an unsubsidised solar park in 2019.

EnBW Energie Baden-Württemberg AG is one of the largest energy utilities in Germany and Europe. Headquartered in Karlsruhe, the company employs over 24,000 people and supplies around 5.5 million customers with electricity, gas and water, as well as energy solutions and energy-related services.

Energiekontor AG, which is based in Bremen, was established in 1990. Since then it has realised 126 wind farms and eleven solar parks with total output in excess of one gigawatt. This represents an overall investment of more than EUR 1.7 billion. The company’s shares are listed on the General Standard of Deutsche Börse in Frankfurt.
