CMS Hasche Sigle advises montanSOLAR on photovoltaic projects

Hamburg – montanSOLAR GmbH of Sulzbach an der Saar has already successfully completed seven large ground mounted photovoltaic projects in the German state of Saarland. Two of these solar parks, Mellin III (around two megawatt peak, MWp) and Dechen (around 1.5 MWp), both located close to the company’s headquarters, have recently been sold. Together, they are capable of supplying environmentally-friendly power to around 1,100 households and represent a total investment of more than five million euros.

A CMS Hasche Sigle team led by Dr Niklas Ganssauge advised montanSOLAR on all legal aspects of selling Mellin III to a family foundation and Dechen to KEW Kommunale Energie- und Wasserversorgung AG. The company has been relying on the law firm’s legal expertise on a regular basis over the last two years. CMS Hasche Sigle is also providing extensive support to montanSOLAR on a further project due to be implemented shortly. With an output of around 7.9 MWp, the 15 hectare Brönnchesthal solar park is one of the largest of its type in Saarland and is capable of supplying solar power to approximately 2,400 households.

montanSOLAR is a joint venture with Essen-based RAG Montan Immobilien GmbH as the majority partner. The latter manages and develops real estate property for RAG Aktiengesellschaft in the Ruhr metropolitan region and in Saarland. This mainly involves developing former mining sites, which are conversion areas as defined by the German Renewable Energies Act, for photovoltaic projects. montanSOLAR constructs the parks in conjunction with various general contractors and then sells them on to investors.
