German trademark rights and domains of Neckermann.de go to Otto Group

22/11/2012

Frankfurt – The Otto Group has acquired the rights to the Neckermann.de trademark in Germany and related brand names from the insolvency assets. The distinguishing marks that have been acquired include use of the trademarks, logos and most Internet domains, such as www.neckermann.de and www.neckermann.com. The acquisition is currently awaiting approval from the German competition authorities. Neckermann.de filed for insolvency in July 2012.

"The open bidding procedure for the trademark rights and domains was highly successful. It was set up and conducted by the insolvency administrators with the support of Ernst & Young," said Joachim Kühne, insolvency administrator and partner at CMS Hasche Sigle. "It looks like the long-established Neckermann name will survive, which would be very gratifying."

The Otto Group also gets the option of using Neckermann.de address data for soliciting former customers via Neckermann.de GmbH. The customer data will remain under the control of the insolvency administrators and will be used in compliance with data protection legislation.
