Oil industry: CMS Hasche Sigle advises Deutsche Bank and HSH Nordbank on EUR 205 million financing for international Bominflot Group

Hamburg – Under the lead management of Deutsche Bank AG, HSH Nordbank AG, ABN AMRO Bank N.V. and ING Bank N.V. (mandated lead arrangers), a consortium comprising a total of nine German and international banks has provided operational funding of EUR 205 million to the Bominflot Group.

A team led by lead partner Dr Thomas de la Motte advised in particular Deutsche Bank as Security Agent and HSH Nordbank as Facility Agent on all aspects of negotiating and designing the Syndicated Revolving Credit Facility Umbrella Agreement, providing German and non-German collateral and replacing existing finance arrangements. The associated CMS law firms CMS Cameron McKenna in England, CMS Albiñana & Suárez de Lezo in Spain, CMS Derks Star Busmann in the Netherlands and CMS Bureau Francis Lefebvre Mercosur in Uruguay worked together closely in advising on the complex cross-border transaction. Further law firms were involved in the other countries concerned.

Hamburg-based Bominflot Bunkergesellschaft für Mineralöle mbH & Co. KG is one of the world's largest independent players in the bunker oil market. In addition to the parent company and its German subsidiaries, other international Bominflot Group companies are directly involved in the financing as borrowers and guarantors.
Both the Bominflot Group's relationship banks and selected new banks participated in the syndicated finance deal.
