Project Finance Award 2008 for project advised by CMS Hasche Sigle: A-Model A 1 motorway is "European Road Deal of the Year"

The renowned "Project Finance Magazine" has awarded the title "European Road Deal of the Year" to the biggest German PPP project to date in the trunk road sector - the extension of the federal motorway A 1 between Bremen and Hamburg.

CMS Hasche Sigle is a member of the advisory team that developed the building contract award procedure and provided advice throughout the tender procedure and contractual negotiations of this Public Private Partnership until the contract was concluded. “The special aspect of the A 1 deal was that we were able to bring a major project to a financial close with market risks in a difficult banking situation, said Dr Christian Scherer- Leydecker, who was lead partner for CMS Hasche Sigle in this project.

For ten years, Project Finance Magazine has been issuing awards to infrastructure finance projects having performed best – according to innovation, deal repeatability, best practice, problem solving, risk mitigation, value for money and speed of delivery. A 1 won this award in the face of competition from approx. 300 other deals.

CMS Hasche Sigle advised the Federal Ministry of Transport and the Lower Saxony Government Ageny for Road Construction on awarding the operating model’s pilot project “BAB A 1 Hamburg-Bremen. In June 2008, the state authority accepted the tender for the consortium A1mobil consisting of Bilfinger Berger, John Laing and Johann Bunte to expand the 73 kilometre section of the A1 motorway between the Bremen junction and the Buchholz three-leg junction near Hamburg.

This PPP project encompasses expansion and financing, as well as maintaining operation of the motorway section for a period of 30 years (A Model). In return, the concessionaire receives remuneration from the truck tolls for the motorway section. The BAB A 1 motorway project in Lower Saxony is the third PPP project to be awarded for German motorways. The tender procedure for another pilot project for the A Model A 5 in Baden-Württemberg (Malsch-Offenburg) is still ongoing. The team around CMS Hasche Sigle is also providing advice on this A Model, as it did on the other projects completed in 2007.

The Federal Ministry of Transport has furthermore annunciated the awards of contract for other A Model projects. On 29th January, 2009 the ministry published the public announcement on the award procedure for the motorway project BAB A 8 Ulm Augsburg.
