From negotiation to exploitation

The life of a platform necessarily includes a design and development phase which may be preceded by a tender phase and an exploitation phase. During each of these phases, service providers may be involved in the design, development, implementation or hosting of the platform, but also in ensuring its maintenance and regulatory compliance.

To secure the relationship with these service providers, the IP/IT team will assist you at all these stages:

  • from the tender phase (preparation and follow-up: drafting of legal requirements, scoring);
  • during drafting and negotiating contracts (development, integration, hosting, SaaS, maintenance, managed services);
  • as well as during the follow-up of the execution of these contracts to obtain service levels in accordance with your legal and operational requirements.

Valuing and protecting your intellectual property rights

The creation and operation of a digital platform, whether developed by third parties or by employees, raises various issues relating to intellectual property. Indeed, the platform may contain components which may be subject to copyright or related rights, such as software, open-source components, graphical interfaces or databases. Other elements, such as its name, its graphic representation (logo) or the domain names could also be subject to a deposit or registration and protected by intellectual property rights.

These intellectual property rights must be valued as intangible assets but also protected. In this regards, the IP/IT team advises you to establish a strategy and to guarantee the enforcement of these rights by third parties and to ensure the protection of your interests.
