Understand and adapt to the requirements of the anti-wastage and circular economy law

Law no. 2020-105 of 10 February 2020 on combating wastage and on the circular economy ("loi relative à la lutte contre le gaspillage et à l’économie circulaire", hereinafter "AGEC Law"), has revolutionised certain production and consumption habits. Today, the AGEC Law is nearing completion.

The objective of the legislation was ambitious: to break with the model of the linear economy (extract, manufacture, consume, throw away) and adopt a “circular” economic model based on the eco-design of products, responsible consumption, the extension of shelf life and recycling of products and waste.

This environmental aim resulted in a significant number of new constraints for companies, inevitably accompanied by various sanctions, mainly administrative fines.

While most of the measures were to apply immediately, others were deferred to allow economic players a reasonable transition time.

Others still required the adoption of decrees or orders to be fully operational. In this respect, there has been significant progress, with 54 decrees already published in application of the AGEC Law. Only fourteen implementing measures are still pending, three of which are currently scheduled for the end of 2023, 2024 and 2028 respectively.
