The last year has seen important developments in privilege and disclosure, with a new disclosure practice direction being piloted in the Business and Property Courts and significant court decisions on how privilege and without prejudice protection apply – or don’t apply – in contexts ranging from investigations and expert reports to multi-party litigation and settlement negotiations. A common thread emerging from these decisions is a new focus on the distinction between legal and commercial considerations in litigation.

Our panel will share insights into how the disclosure pilot is operating in practice, provide practical guidance on when privilege can be relied upon and protected to avoid disclosure of sensitive information to third parties, and suggest what you need to bear in mind when navigating this new landscape.
