The EU’s Foreign Subsidy Regulation (FSR) will come into force on 12 July 2023. It sets out important new rules which enable the European Commission to review financial contributions by non-EU governments to businesses, plugging the gap between the already existing merger control and FDI regimes. The FSR introduces three important new instruments including mandatory notification tools for certain mergers and concentrations, and certain public procurement proceedings, in addition to a general investigative tool enabling the Commission to initiate proceedings without prior notification. This session looks at the new rules, thresholds, and explains how parties can practically self-assess and comply with the new requirements.
