Nigel Lewis leads the Infrastructure, Construction and Energy (ICE) Disputes team in CMS Manchester.

Nigel is a Construction & Engineering dispute resolution specialist with over 18 years’ experience advising on projects in the construction, infrastructure and energy sectors. He has acted for many of the UK’s largest developers and contractors in some of the largest ‘big ticket’ disputes, and more recently has expanded his practice to focus on the real estate market, acting for some of the largest developers and financial institutions in the UK. Nigel’s reported cases include a number of landmark decisions and he has provided project advisory services on some of the most significant and complex developments in the UK.

Relevant experience

  • Harmon in the landmark case of Harmon v The Corporate Office of the House of Commons, which focused on breaches of EU procurement and other implied obligations.
  • Interserve in the case of Interserve Industrial Services Ltd v Cleveland Bridge UK Ltd where a series of adjudications between sub-contractor and contractor were initiated. The contractor tried to resist enforcement of the second adjudication by maintaining that it could set off the third award, which had been issued during the enforcement proceedings. The TCC rejected this argument.
  • CAMBBA (the contractor) in over 30 disputes in relation to the M6 Toll Road. To include the landmark case of Midland Expressway Limited v CAMBBA which was significant regarding whether equivalent project relief provisions are enforceable.
  • Sandwell MBC in successfully defending a £4m damages claim by a contractor for alleged breaches of procurement.
  • A developer in a multi-million pound claim against an engineer for alleged negligent advise relating to the flooding risks to a housing development.
  • A specialist M&E sub-contractor on a £10m plus claim relating to delays to a luxury hotel.
  • A Local Authority on a multi-million pound claim against the contractor for cost overrun regarding a decent homes initiative.
  • Project advisory services for developers on some of the most significant and complex developments in the UK.
  • Project advisory services for large financial institutions on some of the most significant and complex developments in the UK.
  • Conducted over 50 adjudications and numerous final court and arbitration hearings.
