Welcome to the inaugural CMS IPEC Report. 

This report focuses on trends, decisions, data and updates from the Intellectual Property Enterprise Court and specifically considers the following questions: 

  • Does the IPEC’s £50,0000 costs cap force parties to secure better and more realistic merits assessments at the outset of a matter? Or does the costs cap force less well-off claimants to settle claims more quickly to avoid inevitable irrecoverable costs?
  • What impact has the High Court’s Shorter Trials Scheme had on the number of IPEC cases by offering an attractive alternative?
  • Is IPEC therefore achieving its objective of offering a speedier route for IP claims? 
  • Is IPEC a rightsholder friendly forum?

As part of the report launch we hosted a webinar in conjunction with the Intellectual Property Lawyers Association (IPLA) to discuss the report. The webinar was moderated by Sarah Wright, Head of IP at CMS UK and the panel included:

  • His Honour Judge Hacon, IPEC’s Presiding Judge
  • David Stone, IPEC judge and global head of IP at Allen & Overy LLP
  • Barrister Thomas St Quintin, who has made a significant number of IPEC appearances
  • Will Corbett, Senior Legal Counsel (IP and Litigation) at Sky Plc, who are one of the most regular users of IPEC
  • Nikolas Gregor, IP Partner at CMS Hamburg.

With the benefit of multiple data points, the panel considered whether there are aspects of IPEC procedure which are ripe for reform.
