Gambling laws in Morocco

1. Is there a Gambling Act (or equivalent) in place?

Yes. Law n°23-71 (December 13th, 1971) relating to national lottery and authorised lotteries.

Moreover, there are a few additional laws that provide for gambling games.

2. Is online gambling a regulated activity?

No.

3. Who are the regulators?

There is no proper gambling regulator in Morocco.

4. Do laws set out a clear licensing framework for gambling (including licensing process, criteria, submission requirements, licensing conditions and ongoing compliance requirements)

There is no legislation, regulatory body or regulation that provides for a clear licensing regime for gambling.

Yes.

5.6 Lotteries?

6. Are there Data Protection laws in place?

Yes. The protection of personal data is governed by Law N° 09-08, promulgated by Dahir No. 1-09-15 (18 February 2009), relating to the protection of individuals with regard to the processing of personal data.

6.1 If yes, do they apply extra territorially?

Yes. 

7. Is there a Data Protection Regulator?

Yes, the Commission Nationale de contrôle de la protection des données à caractère personnel (CNDP), created by law n°09-08.

8. Are there any exchange controls restricting the transfer of cash out of and into the country?

Yes.

9. Are there any tax implications of transferring cash in/out of the country?

No.

10. Are there any tax implications of offering trading activities remotely into the country?

Possibly.
