CMS Monaco advised the Oceanographic Institute - Fondation Albert Ier, Prince of Monaco, in the context of a donation

24/02/2022

CMS Monaco advised the Oceanographic Institute - Fondation Albert Ier, Prince of Monaco, in the context of a donation, by Professor Jean Malaurie, of an important part of his collection, composed of a variety of precious items (medals, decorations, Sir Wally Herbert's sledge) as well as numerous paper and sound archives. Preservation of the Arctic environment has always been in the center of Professor Malaurie’s concerns.

In the context of this donation, the Oceanographic Institute - Fondation Albert Ier, Prince of Monaco, has committed to develop the collection in collaboration with the University of Versailles Saint-Quentin-en-Yvelines, and more particularly through a research unit created for this purpose, l’Institut de recherches arctiques Jean Malaurie – Monaco – UVSQ (Jean Malaurie - Monaco – UVSQ Arctic Research Institute).

In order to respect the wishes of each party, it was necessary to qualify the legal relations between the participants of this operation, assuring the implementation of an accurate legal framework.

It was thus decided to draw up a deed of donation with charges between Professor Jean Malaurie and the Oceanographic Institute - Fondation Albert Ier, Prince of Monaco, and a tripartite agreement between these same parties and the University of Versailles Saint-Quentin-en-Yvelines.

The CMS Monaco's team was led by Géraldine Gazo, Partner, and composed of Sandra Adeline and Justine Mounier, Advanced Associates.

The collection was also subject of a descriptive and estimative inventory carried out by the Parisian firm C2L EXPERTISES. The collection is in fact priceless, however, it was still imperative to declare a value in the deed of donation.

Maître Hervé Le Long, Notary based in Dieppe (France), was also included in this operation, having received the deed of donation with charges.

After many months of exchanges between the different parties and their counsels, the deed of donation and the tripartite agreement were signed in November 2021.
