CMS DSB assists Qbuzz

Court declares that Connexxion and Arriva have no case.

On 28 October 2008, the judge in interlocutory proceedings of the Trade and Industry Appeals Tribunal dismissed the objections of Connexxion Openbaar Vervoer N.V. and Arriva Openbaar Vervoer N.V. against two concession decisions of the Rotterdam Urban District and the Province of Friesland addressed to a newcomer on the Dutch market for public bus services, Qbuzz B.V.

Neither Connexxion nor Arriva had submitted a tender for these concessions. As it turned out in retrospect, Qbuzz had. The judge in interlocutory proceedings has ruled that, as Connexxion and Arriva had failed to submit a tender, they cannot be deemed to be interested parties within the meaning of Article 1:2, first paragraph, of the General Administrative Law Act.
