CMS effects reduced penalty for Ballast Nedam


The British Court has reduced a OFT penalty imposed on construction firm Ballast Nedam.

Ballast Nedam appealed against the penalty of € 9 million which was imposed in 2009 by the Office of Fair Trading for breaking the competition law. Ballast plc, a now bankrupt subsidiary, was said to have made mistakes in 2001.

The Competition Appeal Tribunal (CAT) has decided upon appeal to reduce the penalty to € 0,6 million.

Ballast Nedam was advised in this appeal by a team of lawyers led by Robert Bosman. The team furthermore consisted of Kim van Haastrecht, Annemieke Hazelhoff and David Marks (CMS London), as well as two British barristers.
