CMS advises on a high-profile theatre building in prime location in Poland

CMS advises on the construction of a building complex that will accommodate the TR Warszawa Theatre and the Museum of Contemporary Art. The project is being developed at Plac Defilad, located in the immediate vicinity of the Palace of Culture and Science. The new home for the TR Warszawa Theatre will be one of the most modern theatre buildings in the whole of Europe. In January 2021, the TR Warszawa project received its final building permit. 

According to the project’s architectural concept, the TR Warszawa and the Museum of Contemporary Art buildings will complete the spatial arrangement of Warsaw’s Central Square next to the Palace of Culture and Science, in what is part of a larger project known as “Warsaw’s New Centre”. The purpose of this long-term project pursued by the City of Warsaw is to create a space in the heart of the city that will be sophisticated and attractive for residents and visitors. 

Since 2017, CMS lawyers have been advising TR Warszawa in legal matters relating to project development, including real estate law, administrative procedures leading up to the issuance of the building permit, and public procurement law. 

The team of lawyers advising TR Warszawa in the Warsaw’s New Centre project are part of the CMS Real Estate and Construction Department. The team is led by Lidia Dziurzyńska-Leipert, partner, and includes Michał Bork, counsel, Aleksander Grabecki, senior associate, and Wojciech Konwisarz, senior associate.

The TR Warszawa project is being developed by a local cultural institution under the same name and financed from the Capital City’s budget. The theatre construction was included in the City of Warsaw’s Long-Term Financial Plan for the years 2017-2025. 

The TR Warszawa building was designed by the New York architectural firm Thomas Phifer and Partners, in partnership with the Poland’s APA Wojciechowski and Buro Happold, with the consortium made up of ECM Group Polska S.A. and Portico Project Management acting as contract engineers.
