CMS expands its Dispute Resolution practice with team hire

International law firm CMS has strengthened its Dispute Resolution practice in Poland with the appointment of partner Rafał Morek. Rafal joins the firm’s 25-lawyer strong team, headed by Anna Cudna-Wagner, along with Jan Markiewicz as counsel and Andrzej Girdwoyń as associate. The new team members will strengthen the practice in arbitration and construction disputes, as well as disputes in infrastructure projects. 

A Polish-qualified advocate, Rafał will head the CMS Arbitration team. He combines his legal practice with academic work at the University of Warsaw’s Faculty of Law and Administration. As an arbitrator and counsel, he has been involved in over 100 multijurisdictional arbitrations. He is also a mediator and mediation coach, and often acts as a negotiator and member of Dispute Adjudication Boards (DABs). Rafal’s experience includes advising on the preparation and execution of infrastructure projects and conducting project-related disputes. As an expert, he works with institutions such as FIDIC or EFCA. He is a co-author of the FIDIC Golden Principles (2019) and a member of the FIDIC Task Group 15.

Jan is a Polish qualified advocate who specialises in matters related to development and settlement of infrastructure projects, including road, rail and energy projects, with the latter involving both power plants and transmission grids. He advises clients from the stage of analysing the risks of a construction contract and the negotiation of its terms, through to a project’s implementation, including drafting contractual claims and conducting negotiations, proceedings to secure claims, disputes before state courts and arbitration tribunals in Poland and abroad, and during settlement talks. He is also an expert in contracts based on FIDIC templates.

Andrzej specialises in civil and commercial disputes. His experience includes advising
in litigation proceedings arising under construction contracts, compensation cases relating to traffic accidents, and advising on liability for unlawful acts by public authorities. He has advised national and international businesses in the construction, telecommunications, transport and real estate sectors, as well as clients in the creative industries.
