Joanna Mlot is an attorney-at-law and a Counsel in the Dispute Resolution Department at CMS. She has over 15-year experience in representing clients in judicial proceedings, administrative court and arbitration proceedings. She has acted in cases related to construction and real property disputes. She has also provided advice with regard to bankruptcy proceedings and labour law. 

Her experience includes representation of investors and construction companies in the construction and real estate disputes concerning, inter alia, motorways, shopping malls, bridges, sewer systems, sale of real estate, as well; issues relating to the dissolution and renewal of perpetual usufruct. She has represented clients in administrative proceedings related to the validity of the building permit.  

International rankings Chambers Global and Chambers Europe recommend her in dispute resolution in Poland.

Relevant experience

 

  • Representing a leading Spanish manufacturer of formwork and scaffolding systems in 4 court proceedings regarding claims for payment against construction companies and investors. Total value of claims - PLN 14 million;
  • Advising the committee of bondholders in a highly publicised dispute regarding the repayment of bonds, including bankruptcy proceedings and enforcement of security. This case is closely connected with a dispute between Vivendi, Deutsche Telekom and Elektrim over PTC;
  • Representing GDDKiA (The General Directorate of National Roads and Motorways) in an EUR 60 million ICC arbitration with the Contractor in relation to the A4 Motorway project;
  • Representing a retail developer in a highly publicised landmark case regarding 
    an attempt to decrease lease payments in view of the financial crisis;
  • Representing the trustee of the bondholders in high-profile cross-border court insolvency of six separate companies from the group of one of the largest producers of spirits in CEE and France;
  • Representing an owner of commercial centres in a dispute in relation to the sale agreement concerning 14 properties in Poland;
  • Representing an owner of a shopping centre in a dispute with the construction company for defective works resulting with the intervention of the construction supervision authorities;
  • Representing banks in Poland in multi-million disputes concerning claims resulting from derivatives transactions;
  • Representing a developer in a dispute concerning violation of the preliminary sale agreement concerning a property in Poznań;
  • Advising corporate clients in several mobbing cases.
