Marcin Zbytniewski is an advocate and Counsel in the Dispute Resolution Department at CMS.

Marcin represents the clients in litigation - the main field of his legal work covers civil litigation and particularly construction (infrastructure) disputes in which he has wide experience in representing both general contractors and the employers. He is also experienced in negotiating complex settlements, covering many aspects of the investment process.  

Marcin also deals with labour litigation – he represents ex-employers as defendants in the cases initiated by their ex-employees resulting from termination of contracts, overtime, discrimination or claims for different kind of bonuses.

  • Mostostal Warszawa in relation to two proceedings related to the construction of a bio-mass energy plant in Elbląg. 
  • Mostostal Warszawa in relation to two proceedings related to construction of waste incineration plant in Szczecin.
  • Arcadis on a dispute with a contractor of the A4 motorway in Poland.
  • Arcadis in relation to a dispute against the State Treasury - the General Director of the National Roads and Motorways.
  • IBM on an alleged infringement of public procurement law in relation to contracts with the Polish Ministry of Interior for the supply and implementation of complex IT systems.
  • A railway construction company in relation to several complex construction disputes with PKP Polskie Linie Kolejowe S.A. concerning projects of a total value of over EUR 52 million.
  • A construction company on complex disputes with a municipal company in relation to the development of a sewage treatment plant based on a standard FIDIC contract.
  • A Polish heat and power company in relation to high-value commercial arbitration concerning delays in performing a turnkey contract concerning the construction of a combined heat and power plant by a general contractor.
  • An Austrian construction company on a number of claims under a contract for the construction of a section of the A1 motorway and in particular related to defects and errors in the construction design of the motorway bridge. 
  • A consortium of Polish and Romanian construction companies in a complex multi-million construction dispute related to intelligent traffic management system against one of the Polish municipalities (the City) with the participation of the Client’s subcontractor.
