Rafał Dostatni is a Polish certified tax advisor and an Associate in Tax Team, in the Corporate / M&A Department at CMS. 

He advises on tax issues (PIT, CIT, PCC and VAT), especially as regards tax optimisation, and assists clients with requests for interpretation filed with fiscal authorities. He has also a growing experience in M&A and asset deal transactions, where he advises both in tax and corporate matters (incl. liquidation of companies with real estate as a main asset).

  • Offsite Archive Storage & Integrated Services (Ireland) Ltd. (OASIS) (Montagu Private Equity's portfolio company) - on the tax aspects of the acquisition of 100% of shares in Archidoc S.A. and in ArchiDoc MED sp. z o.o. from OEX Group.
  • Alligator Ventilfabrik GmbH and Alligator Polska sp. z o.o. - companies from the automotive sector, on the tax aspects of the sale of assets in Poland and in Germany to the companies from the Wegmann Automotive Group.
  • mBank (Polish bank from the Commerzbank Group) - on preparing a structure and establishing mAccelerator - a corporate venture capital fund of mBank. This is an innovative legal structure of a corporate venture fund established by a Polish bank and the first and the biggest fund of this kind in the CEE, the goal of which is development and commercialization of the new technologies in the financial sector through buying and developing of home-grown technology start-ups (fin-tech).
  • mBank S.A. - in relation to corporate and tax matters connected with restructuring companies within the capital group of mBank S.A.
  • EGGER Group - in relation to the first greenfield-type investment in Poland, with a value of approximately PLN 1 billion.
  • CVC Capital Partners – tax advisory related to purchasing the Żabka Polska chain of convenience stores from the Mid Europa Partners fund.
