Meet the Law – Order no. 6304/2021, of June 25

Order No. 6304/2021, of June 25, was published today in the Official Gazette and regularizes the compensations made between 2013 and 2020 and the remuneration due to wind power plants covered by Decree-Law No. 35/2013, of February 28 (Decree-Law No. 35/2013).

Such compensations are due by the promoters of wind power plant projects under the regime prior to Decree-Law no. 33-A/2005, of February 16, which have adhered to an alternative remuneration scheme for the additional period of 5 or 7 years after the end of the applicable remuneration scheme, under article 5 of DL no. 35/2013.

The Order determines (i) the promotion of the regularization of the annual compensations received between 2013 and 2020 and the remunerations already paid to the wind power plants under the remuneration extension regime, plus interest due, according to the successive application of the correction factor Kn; and (ii) the successive application of the correction factor Kn to the minimum and maximum limits of the remuneration schemes to be applied to the wind power plants covered which have not yet entered the respective 5 or 7 years extension period. These aspects shall be made operational under the terms to be defined by the Energy Services Regulatory Authority.
