As the world comes out of the COVID-19 pandemic, the efforts of recovery and rebuilding nations and economies have begun in earnest. All Southeast Asian economies are seeing an increase in infrastructure investments as a result of the need to drive economic growth and improve social progress. Mega announcements of public and private spending are being made across multiple sectors. While providing multiple opportunities for all stakeholders, this post-COVID renaissance of infrastructure development in Southeast Asia is also throwing up its own unique set of issues and challenges.

The 2023 CMS APAC Construction Conference will focus on the different issues and challenges that one may expect to encounter while executing a large or mega infrastructure project in the ASEAN region and during this economic climate.

There is no charge to attend the event, and spaces are available on a first come first served basis so we encourage early registration.

09:00 -  Panel 1 - Managing disputes and claims - The importance of applicable law 

Depending on where your project is situated and what the governing law of your contract is, the same construction law issue may throw up a different response. Being aware of the different ways issues such as limitation periods, preconditions to extension of time and performance bonds are treated in a particular jurisdiction is crucial to the effective management of risks and assessment of claims in a construction project. This panel will look at the latest developments in different jurisdictions in Southeast Asia and highlight the key issues that are particularly affected by the applicable law.

11:00 - Panel 2 - What's in a name? - Understanding prolongation, disruption and acceleration cost claims

Complex engineering and construction projects often experience delays and disruptions to planned completion, and attempts to recover time loss are common. Construction contracts typically make provision to allocate the risk of cost overruns for delay and disruption between employer and contractor. However, difficulties in identifying, proving or assessing entitlement for the different types of time-related cost overruns remain all too common in practice. This panel looks to give a practical guide and insights to the key ingredients of prolongation, disruption, and acceleration cost claims.
