On December 15, 2020, the European Commission announced two important legislative initiatives

  • On  the one hand, the so-called Digital Services Act will replace the twenty-year-old e-commerce directive 2000/31, not a day too soon, because e-commerce in 2000 is not comparable to e-commerce today. 
  • On the other hand, there is also the Digital Markets Act, with which the Commission wants to protect European consumers and businesses against unfair market practices by providers of online platforms such as Google, eBay, TikTok or Apple.

With this, Europe continues to build on the rules of the digital economy, which were already expanded in 2019 with the so-called Omnibus Directive for Consumer Protection (No. 2019/2161) and the Regulation on Online Marketplaces (No. 2019/1150).

These will soon lead to amendments to Books VI and XII of the Belgian Code of Economic Law.

The European legislature has thus taken several initiatives to better protect European consumers and companies when doing business online. To protect them, all technology companies will have to comply with the new rules in the EU, even if those companies are based outside of Europe.

Europe also wants to create a level playing field in which European companies can develop as fully-fledged on-line service providers.
