Carbon capture usage and storage

CMS is the only major law firm to have advised on all of the UK competitions for CCUS projects to date as well as having worked on CCUS projects with the EU Commission and internationally. This allows our market-leading practice to delve deep into the issues that CCUS projects need to consider.

Selected relevant experience includes advising:

  • BP, Eni, Equinor, Shell and Total and previously OGCI Climate Investment LLP’s: on its development of the Clean Gas Project
  • Summit CCUS Project: on strategic issues and structuring considerations, consenting and preparatory matters, and all regulatory matters.
  • National Grid Carbon Limited: on the negotiation, drafting and execution of the Front End Engineering and Design (“FEED”) Contract and on the negotiation of heads of terms and contract principles for the main project contract.
  • Don Valley CCUS Power Project: on all aspects of client’s participation in and the successful award of €180 million grant from the European Energy Programme for Recovery advising on the NER-300 scheme application.
  • First UK Carbon Storage Licence: in relation to its engagement with Government on the implementation of the EU CCS Directive (Directive 2009/31/EC) into UK legislation; Negotiated terms of client’s CCS Storage Licence with Government.
  • First UK CCUS land rights: on negotiations of the necessary land rights for storage of CO2 leading to the execution of an agreement for lease with The Crown Estate Commissioners.
  • First UK CCUS Development Consent Order: in relation to regulatory and consenting aspects of the offshore pipeline developments.
  • Captain Clean CCUS Project: on the negotiation and drafting of the Front End Engineering and Design (“FEED”) Contract as part of bid documentation for submission to Government,
  • Teesside CCUS Project: in relation to preparation of responses to tender documentation issued by Government.
  • Longannet CCUS Project: on all aspects of negotiation, drafting and execution of the Front End Engineering and Design (“FEED”) Contract and negotiation of full project contract.
