Notification requirement holiday rental

On 18 August 2017, the Amsterdam Housing Regulation has been amended in an attempt to curb the growth of Airbnb and similar platforms and to accommodate rising concerns around illegal hotels and the nuisance that they create for the city's residents. The Amsterdam Housing Regulation requires that home owners who rent out their homes to holiday makers notify the municipality of each rental. Home owners are not allowed to rent out their homes for a period longer than 60 days a year in aggregate and to more than 4 persons at one time. The amendment becomes effective on 1 October 2017.

The notification is done online by completing a designated form that is available on the municipality's website. Non-compliance with the notification obligation may trigger a penalty of € 6,000 per offence. The penalty can be increased up to € 20,500 if the 60 day period or 4 persons maximum are exceeded. It goes without saying that the new rule applies to all possible platforms (including Airbnb, Wimdu, 9Flats, Booking.com etc.).
