On 21 December 2023, the Swiss Federal Council and HM Treasury in the UK announced the signing of an agreement on mutual recognition in specific areas of financial services between Switzerland and the UK referred to as the Berne Financial Services Agreement (the Agreement). The conclusion of this ground-breaking Agreement is the culmination of more than two years of negotiations following the signing of a Joint Statement on 30 June 2020 aiming at enhancing cooperation in financial services between Switzerland and the UK. 

Zurich,  No­vem­ber 2023A team of CMS Switzerland and CMS Luxembourg, lead by partner Matthias Kuert, advised Float Finance AB, Stockholm, Sweden, on legal and tax aspects of a tokenized debt instrument issued under Swiss law by a Luxembourg Special Purpose Vehicle. The instrument labelled FLOAT1 is one of Europe's first private debt asset tokens, and a great example of a tokenized financial instrument issued under the landmark Swiss DLT legal framework. The FLOAT1 token offers investors access to a diversified portfolio of private SME loans to European SaaS and technology businesses. Float worked together with banking partner Sygnum Bank AG, Zurich, Switzerland, and senior lender, Fasanara Capital Ltd, London, England (one of Europe's largest FinTech credit funds), to tokenize and issue the debt instrument within a fully regulated environment. By way of the FLOAT1 token, Float brings illiquid real-world financial assets onto the Polygon Labs blockchain to make them accessible to investors and tradeable. Float, Sygnum Bank, Fasanara Capital and CMS closely collaborated to make the issuance of the FLOAT1 token happen. Un engagement conjoint en faveur d’un écosystème suisse du métavers à la pointe de l’innovation : 47 organisations partenaires de l’économie, de la science et de l’ad­mi­nis­tra­tion lancent la Swiss Metaverse Association. Ces organisations visent l’ap­pren­tis­sage commun, l’échange d`idées, la création de preuves de concepts (proof of concepts) et la promotion de con­di­tions-cadres favorables, afin d’établir la Suisse comme l’un des leaders mondiaux du métavers. CMS Suisse est im­pli­qué.L’ob­jec­tif de cette association récemment fondée à Berne est de développer un écosystème du métavers bénéficiant d’un large soutien et de s’engager pour des con­di­tions-cadres favorables en Suisse, afin de favoriser la création de nouveaux modèles économiques, d’entreprises et de places de travail. La Swiss Metaverse Association (en bref : Metassociation) est co-présidée par Tina Balzli, Partenaire et Responsable de la Division Fintech & Blockchain chez CMS, et Alexandra Hofer, Senior Consultant chez fur­re­rhugi.« Avec cette association, nous voulons créer les bases nécessaires à ce que la Suisse puisse se positionner comme un lieu tourné vers l’avenir qui rend possible la mise sur pied de projets dans le métavers. Nous voulons connecter entre eux les acteurs pertinents, initier des projets et promouvoir le dialogue et le partage d’in­for­ma­tions » déclare Tina Balzli, fraichement élue co-présidente de l’association. Grand besoin d’échanges sur le métaversLe projet « Me­tas­so­cia­tion » a été initié conjointement par Lorenz Furrer, Managing Partner chez furrerhugi, et Daniel Diemers, partenaire auprès du Groupe SNGLR. Daniel Diemers est également membre du comité de la Swiss Metaverse Association. Parmi les membres fondateurs se trouvent des organisations, des banques, des entreprises internationales, des start-ups, des universités, des associations ainsi que des individus. Les rencontres avec les membres fondateurs ont jusqu’ici démontré que le métavers offre bel et bien des possibilités et des chances, mais pose tout autant de questions et de défis – dès lors, les membres ont éprouvé un besoin accru de pouvoir échanger et se pencher sur ces questions fondamentales.« Nous nous réjouissons que la Swiss Metaverse Association ait été accueillie de manière aussi positive. Ses 47 membres fondateurs disposent d’une expertise variée dans des domaines très différents – une valeur-ajoutée importante pour l’association. Aborder de manière pro-active les questions relatives au métaversLa Swiss Metaverse Association prévoit d’organiser divers événements. Dans le même temps, elle a l’intention de former des groupes de travail qui se pencheront sur des questions et des thèmes spécifiques. Parmi les thèmes prioritaires figurent notamment la fiscalité, le métavers industriel, la réglementation, l’art et la culture, la recherche et la formation, les assurances et les banques, la technologie et les infrastructures, la santé ainsi que le tourisme et le sport. Il est également prévu de rédiger un White Paper et d’établir une carte de l’écosystème suisse du métavers.
