Consumer protection

Back to Antitrust, Competition and Trade

Monitoring consumer protection has been one of the priorities of the European Commission and the Romanian consumer protection authority (the National Authority for Consumer Protection) In this challenging and increasingly regulated legal environment, we help companies adapt their business strategies and comply with the law.

Specifically, we support clients with drafting and amending consumer T&Cs and various internal policies. We assess and advise on advertising activities (including promotional offers or price changes), including advice on complex consumer claims that relate, e.g. to contract conformity, warranty or product returns, product labelling, media campaigns for promoting products and services, setting up e-shops and selling products on various digital platforms. We represent clients in inspections carried out by officers of the National Authority for Consumer Protection, as well as in judicial and administrative proceedings related consumer protection claims.

Finally, we support clients in developing strategies and step plans on adjusting their activity, particularly given the rapid pace at which both EU and national legislation changes, particularly regarding dual quality products, greenwashing practices, ESG requirements, food legislation, etc. Wherever necessary, we comment on draft legislation, upcoming changes and how to best address these.
