Mitch is an Associate in the Infrastructure, Construction and Energy Disputes practice at CMS in Riyadh. He has over five years of post qualification experience representing clients on complex construction and infrastructure disputes, with a particular focus on Saudi Arabia and the wider Middle East.

He regularly advises on high value claims arising during project delivery and following completion, including disputes relating to payment, variations, delay and disruption, termination, defects and the pursuit and enforcement of claims.

His experience includes acting in arbitrations under the SCCA, UNCITRAL, ICSID and ACICA Rules, as well as advising on proceedings before the Saudi courts and on the interface between Saudi law and international arbitration.

Mitch has also acted on complex construction disputes before the senior courts of Australia and England and Wales, and in cross‑border arbitrations across the Middle East, Africa, Asia Pacific and Europe. He works closely with clients on dispute strategy, jurisdictional and enforcement considerations, and the management of disputes on major infrastructure and energy projects.

  • A leading international contractor specialising in large-scale infrastructure and engineering works in its Riyadh seated SCCA proceedings arising out of payment claims relating to a Saudi giga project. 
  • A pre-eminent geotechnical specialist subcontractor in its Riyadh seated SCCA proceedings arising out of payment claims relating to a Saudi giga project. 
  • Subsidiaries of Italian multinational oilfield construction services company Saipem S.p.A (Saipem) in its Perth seated UNCITRAL arbitration of a USD 1.9bn dispute with Chevron arising out of the construction of a liquefied natural gas (LNG) loading jetty built as part of one of the world’s largest LNG plant projects (the Gorgon Project).
  • An International Development Fund in relation to a dispute relating to the construction of a high-profile hospital project in Saudi Arabia.
  • A leading Saudi contractor in connection with claims arising from material price increases across a portfolio of 15+ Government and non-Government construction projects in Saudi Arabia.
  • An Italian contractor in relation to its entitlement to recover over USD 1.2bn in relation to various claims arising across two major oil and gas engineering, procurement and construction projects in Saudi Arabia. 
  • A Chinese contractor in relation to a dispute brought by a leading Saudi employer for over USD 340m in respect of alleged defects in the construction of a residential development.
  • An Italian contractor in relation to a dispute relating to a performance guarantee provided in connection with the construction of a multi billion-dollar oil and gas project in Syria.
  • A Spanish contractor in connection with disputes relating to defect and payment claims in the context of an infrastructure project in the Red Sea, Kingdom of Saudi Arabia.
  • A premier Australian construction contractor in its Sydney seated Australian Centre for International Commercial Arbitration (ACICA) with a leading international transport infrastructure subcontractor.
