Hybrid working model expressly recognised under the Regulation on Remote Working

The Ministry of Labour and Social Security (“Ministry”) published an amendment to the Regulation on Remote Working (“Amendment”) in the Official Gazette dated 25 September 2026 and numbered 33381. The Amendment formally introduces the hybrid working model into the regulatory framework by recognising arrangements under which employees perform part of their work at the workplace and part remotely. The Amendment entered into force upon its publication.
Key Findings
The Amendment expressly regulates the hybrid working model, under which an employee performs part of their work obligation at the workplace and part remotely. A key aspect of the Amendment is the requirement to specify in the employment agreement the days and working hours during which the employee will work remotely and at the workplace. The Amendment represents a significant step towards aligning the legal framework with workplace practices that have already become commonplace, particularly among multinational and global companies.
In Practice
Prior to the Amendment, these matters could generally be determined more flexibly, either within the scope of the employer’s managerial prerogative or through mutual agreement between the parties. The new requirement to specify workplace and remote working days and hours in the employment agreement may affect the degree of flexibility currently enjoyed by employers and employees.
Whether this provision is intended to limit such flexibility or, alternatively, to provide employees with greater certainty and predictability remains to be seen. The practical implications of this requirement, including the extent to which it may restrict operational flexibility, are likely to become clearer through future practice and judicial interpretation.
