Türkiye introduces temporary capacity flexibility for licensed power plants

The Turkish Energy Market Regulatory Authority (Enerji Piyasası Düzenleme Kurumu) (“EPDK”) has published its Decision numbered 13922 (“Decision”) in the Official Gazette on 11 November 2025, introducing a temporary mechanism that allows licensed electricity generation facilities to operate above their contracted capacity during the upcoming winter period. The measure, which will apply between 1 December 2025 and 28 February 2026, is intended to support electricity supply security in anticipation of higher seasonal demand. The Decision does not extend to unlicensed generation facilities.
Under this temporary framework, licensed generators may apply to TEİAŞ (Türkiye Elektrik İletim Anonim Şirketi) or the relevant distribution company to deliver electricity in excess of their existing connection or system usage agreement limits. Once an application is submitted, the increased output may begin on the fifth business day for transmission-connected facilities and on the tenth business day for distribution-connected facilities. System operators retain the right to limit or refuse the requested increase if necessary for technical or system security reasons, and any such restriction must be notified within five (5) days. Companies may challenge these limitations by filing an objection with EPDK within thirty (30) days.
Throughout the implementation period, generators’ fixed system usage fees will continue to be calculated based on their current contracted capacity. However, any additional electricity supplied under this temporary flexibility will still be considered when assessing the plant’s available capacity. The arrangement is therefore designed to provide short-term operational flexibility without altering the underlying tariff structure.
For licensed generators, this measure offers a practical opportunity to adjust production strategies during the winter months without facing administrative sanctions for capacity overruns. Companies expecting increased output should review their operational plans and file applications promptly, bearing in mind that system operators may impose limitations where grid stability requires it. Further clarifications from EPDK or system operators may follow as the implementation period approaches.
