Bernt Elsner will talk about the interpretation of exclusion grounds. In a case dated 3 October 2019, the Court of Justice clarified important issues in connection with the process of excluding a bidder. The ruling describes the tasks of a contracting authority to determine exclusion grounds.

In October 2019, the Court of Justice issued a confusing and potentially revolutionary judgment in the Irgita case (C-285/18), which concerned the award of a contract to an in-house entity. In this webinar, Lenka Krutáková will give you a sketch of the deep implications that the case could have and the interpretive complications it is already generating.

Youri Musschebroeck will describe the impact of corporate restructuring, including takeover, merger, acquisition on running public procurement procedures. The Court of Justice provided us with new relevant guidelines regarding such transactions (case C-697/17) on 11 July 2019, three years after the first guidelines were laid down in the  MT Højgaard and Züblin-case of 24 May 2016 (C 396/14). Finally Youri Musschebroeck will comment on article 72 of the directive 2014/24 under which public contracts may be modified without a new procurement procedure in the case of corporate restructuring.
