Unfair Trading Practices in the Agri-Food Supply Chain in CEE: a new state of play

The functioning of the food supply chain has been subject to analysis by the European Commission (the Commission) since 2008. One of the main findings was the existence of imbalances in bargaining power between businesses operating at different levels in the supply chain.

Following the findings, the Commission adopted directive (EU) 2019/633 of the European Parliament and of the Council (the Directive) on 17 April 2019. The Directive was to have been transposed into the national laws of the EU Member States by 1 May 2021, but some EU Member States postponed the date of its entry into force until 1 November 2021. On that date, the EU Directive on unfair trading practices in business-to-business agri-food supply chains came into full effect. This now means that certain unfair trading practices in the agricultural sector are forbidden.
